We have more than enough states to we can pass ERA if the deadline were removed.

News update:
The attorneys general of the three most recent states to ratify the order—Virginia, Illinois, and Nevada—filed a lawsuit against the Archivist of the United States, who’s responsible for keeping track of constitutional amendments.

The states are trying to convince the courts—namely the Supreme Court—to resolve this issue.
  • On March 22, 2017, 45 years to the day after Congress passed the ERA, Nevada became the 36th state to ratify it.
  • On May 30, 2018, Illinois became the 37th state.
  • On January 15, 2020, the state of Virginia become the 38th state to ratify.
The 38th state is the one we were waiting for!
Now that deadline needs to go so women can have equal rights under the Constitution and those piecemeal protections can fade away and it won't hurt. Literally.
Both Justices Antonin Scalia and Ruth Bader Ginsgburg have stated that gender equality is not a Constitutionally protected right.
